enotarypublic.ca ("we", "us", "our") welcomes you to its website (the "Website"). Please read these Terms of Use before using the Website or the Services made available through it. By accessing or using the Website or Services by any means, you agree to be bound by these Terms of Use.

IF YOU DO NOT AGREE, YOUR SOLE RECOURSE IS TO LEAVE THE WEBSITE IMMEDIATELY. If you are using the Website on behalf of an organization, you represent that you have authority to bind it to these terms.

Browsing this site, requesting information or receiving a price estimate does not create a binding agreement or charge you anything. A binding service agreement is formed only when you (1) confirm your booking and (2) authorize payment at checkout. Until then you may leave at any time with no obligation.

The Website and Services are owned and operated by enotarypublic.ca. All content, data, graphics, trademarks and the "look and feel" of the Website (the "Content") are proprietary to enotarypublic.ca, its affiliates and/or third-party licensors, and protected by Canadian and international copyright and trademark laws.

You may not modify, copy, reproduce, publish, distribute or sell any Content without our express prior written consent, except for your own non-commercial, informational use provided you retain proprietary notices and cite the source URL.

To access certain portions of the Website you may need to register. You agree to provide accurate information and keep your password confidential. You are responsible for all activity under your account and must notify us immediately of any unauthorized use.

You represent that any information you submit is accurate and complete. Personal data you submit remains subject to our Privacy Policy.

We may make available the ability to pay for services through the Website. You represent that you have the right to use any payment method you submit, and you agree to pay all charges you incur at the prices in effect when incurred, plus applicable taxes.

Before you pay, we will clearly show you: our legal and business name and contact information; a description of the service; the itemized price, any additional fees, applicable 13% Ontario HST, and the total in Canadian dollars; and this cancellation and refund policy.

After you pay, we will deliver a copy of your agreement — your receipt and booking confirmation — to the email you provide. If we fail to provide the required disclosure or a copy of the agreement, you may have a right to cancel under Ontario's Consumer Protection Act, 2002.

Before you pay. No charge is made until you confirm your booking and authorize payment. You may abandon a booking at any time before that point at no cost.

Cancelling or rescheduling. You may cancel or reschedule an appointment free of charge up to 24 hours before the scheduled start time; we will refund any amount paid in full, or move your booking to a new time at no extra charge. Within 24 hours of the appointment, [a cancellation fee applies / the service fee is non-refundable but one free reschedule is offered — to be confirmed].

If we cannot complete the service. If the commissioner or notary determines at or before the appointment that the service cannot lawfully or properly be completed — for example, identity cannot be confirmed, the document is not eligible for the service requested, or a legal requirement is not met — we will refund your payment in full. A commissioner or notary must decline in these circumstances; a refund here is not a reflection on you.

No-show. If you do not attend a scheduled appointment and did not cancel or reschedule in time, [the service fee is non-refundable / a no-show fee applies and the balance is refunded — to be confirmed].

After the service is completed. Once the commissioning, notarization or other service has been performed, the fee for that service is earned and is not refundable, because the service has been delivered.

How refunds are made. Approved refunds are issued to the original payment method within [a set number of] business days.

Your statutory rights. Nothing in this policy limits any right you have under Ontario's Consumer Protection Act, 2002 or other applicable law, which prevail over anything inconsistent in these Terms.

THE WEBSITE AND ANY THIRD-PARTY PRODUCTS ARE MADE AVAILABLE "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose and non-infringement.

You agree not to upload unlawful, infringing or harmful material; harvest information about other users without consent; misrepresent your identity; attempt unauthorized access; interfere with our systems; or scrape or data-mine the Website.

To the fullest extent permitted by law, and subject to the paragraph below, our total liability to you for any claim arising out of a service is limited to the amount you paid for that specific service. We are not liable for indirect, incidental or consequential losses.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including under Ontario's Consumer Protection Act, 2002 (which, among other things, prevents contracting out of consumers' statutory rights and the implied warranty that services are of a reasonably acceptable quality), liability for fraud, or liability for personal injury caused by negligence.

Information on this site is for informational purposes only and does not constitute legal or other professional advice, and should not be relied upon as such.

These Terms of Use are governed by the laws of Ontario and the laws of Canada applicable therein. The parties consent to the jurisdiction of the courts in Toronto, Ontario, unless otherwise agreed in writing.

We reserve the right to modify or discontinue the Website or Services at any time. We may change these Terms of Use at any time by posting an updated version. Continued use after a change constitutes your consent to it.
