The Golden Rule: Do Not Sign In Advance
If your document requires a witnessed signature or a sworn affidavit jurat, you must sign exclusively in the presence of the commissioner or notary public (in person or on live video under O. Reg. 431/20). Any document signed beforehand is legally defective and will require re-signing under solemn oath.

What is a notary public and a commissioner?▾
In Ontario these are related but distinct roles. A Commissioner for Taking Affidavits administers oaths, affirmations and statutory declarations. A notary public can additionally certify true copies and authenticate documents for use outside Ontario. Many lawyers hold both authorizations.
Is online notarization available in Ontario?▾
Ontario does not separately regulate “online” notarization. Eligible oaths, affirmations and statutory declarations may be commissioned remotely by two-way video under O. Reg. 431/20 (Commissioners for Taking Affidavits Act). Signature witnessing, certified true copies and Wills & Powers of Attorney require an in-person appointment.
